What is trademark?

Trademark is any sign or any combination of signs used to distinguish products (services), produced (provided) by one individual, from the products (services), produced (provided) by other individuals.

  • If your trademark is not registered, any natural or legal persons can register the trademark used by you in their name. A new “owner” will be entitled to hold you liable under the criminal or civil law for the violation of his exclusive rights to use the trademark.
  • If your trademark is not registered and your enterprise in its commercial activity uses a certain sign for marking its products and services, without knowing that it has already been registered as a trademark and belongs to another person, when the owner finds out about the violation of his rights to the trademark by you, he can not only hold you liable under the criminal or civil law, but also make you compensate for loss, incurred by him due to the illegal use of the trademark.

Registration of trademark in the European Union

Today the registration of a trademark can be carried out in all member states of the European Union: Austria, Belgium, Bulgaria, Great Britain, Croatia, Cyprus, Czech Republic, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Ireland, Italy, Latvia, Lithuania, Luxembourg, Malta, Netherland, Poland, Portugal, Romania, Slovakia, Slovenia, Spain and Sweden.

The application for the registration of a trademark in Europe is to be submitted to the Unified administrative center for trademark registration in the European Union – Office for Harmonization in the Internal Market (OHIM).

Any natural or legal person, who has a permanent residency in one of the EU member countries, permanent establishment in one the EU countries or is a resident of the Paris Convention member state, can register a trademark in the EU.

Filing of an application is executed in one of the official languages of the European Union (English, German or French).

The process of the European trademark registration takes about 7-8 months.
